From the supplier: Insurers are opposing a product-liability reform measure that would transfer fault to the workers’ compensation system. Product makers would be able to claim that injuries were caused by employers or co-employees, not by the products being used. Evidence of employer or co-employee fault would be used to reduce the amount of damages assessed against product makers and against insurers’ subrogation liens. Insurers fear the latter would be eliminated entirely.

From the supplier: The First US Circuit Court of Appeals upheld a lower court ruling that extended immunity from product liability claims to medical device manufacturers. The lower court held that the Medical Device Amendments of 1976 preempted a plaintiff’s claim for relief for damaged caused by a medical device or product approved by the government. The approval by federal regulatory agencies gives the manufacturers protection from product liability suits. The ruling may prove to be of benefit to product liability insurance companies.

From the supplier: The Supreme Court has ruled that medical device manufacturers can be sued for product liability, despite the fact that state product safety standards are legally superceded by federal standards. The decision means that manufacturers must conform to a complex system of product tort liability laws that may differ state by state. Health Industry Manufacturers Assn Pres Alan H. Magazine is concerned that the ruling could have an inhibiting effect on innovative product development.

From the supplier: Participants in two seminars held during the Vermont Captive Insurance Assn’s 1997 meeting predicted that businesses may soon consider captive insurance companies the perfect vehicle for integrating and streamlining their risks. J&H Marsh & McLennan VP Scott M. Sanderson suggested captives as a means of handling both traditional and unusual risks. He mentioned several unusual risks, including product/service warranties, weather variations, and foreign currency exposures.

From the supplier: Bob Hunter, the director of insurance for Consumer Federation of America, has issued a report stating that product liability costs about 26 cents per $100 of retail product sales and that the current system for product liability is adequate. Hunter’s report, however, has several logical flaws. Fear of lawsuits leads to higher manufacturing and services costs and lawsuits themselves are inefficient and expensive.
