From the supplier: Insurers are opposing a product-liability reform measure that would transfer fault to the workers’ compensation system. Product makers would be able to claim that injuries were caused by employers or co-employees, not by the products being used. Evidence of employer or co-employee fault would be used to reduce the amount of damages assessed against product makers and against insurers’ subrogation liens. Insurers fear the latter would be eliminated entirely.

From the supplier: The First US Circuit Court of Appeals upheld a lower court ruling that extended immunity from product liability claims to medical device manufacturers. The lower court held that the Medical Device Amendments of 1976 preempted a plaintiff’s claim for relief for damaged caused by a medical device or product approved by the government. The approval by federal regulatory agencies gives the manufacturers protection from product liability suits. The ruling may prove to be of benefit to product liability insurance companies.
